DrumTag.com Terms of Service

1. Binding Terms

By registering for, accessing, or using DrumTag.com, its mobile applications, signage systems, or any related services (collectively, the “Services”), you agree that you have read, understand, and accept these Terms of Service, along with all operating rules, policies, and procedures referenced herein. If you do not agree, you may not use the Services.

2. Our Privacy Commitment

Privacy is our highest priority. We serve as a secure intermediary between customers and participating locations.

  • We never sell personal information to third parties.
  • We do not share end-user contact details (name, email, phone, etc.) with locations unless the user explicitly enables sharing.
  • We transmit anonymous engagement data (check-ins, redemptions, metrics) to locations so they can fulfill offers and measure performance without revealing personal details.
  • We use industry-standard security safeguards to protect data against loss, theft, or unauthorized access.
  • We prevent spam and unauthorized marketing through strict data-handling policies.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

4. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on DrumTag's website for personal, non-commercial transitory viewing only. Under this license you may not:
    1. Modify or copy the materials;
    2. Use the materials for any commercial purpose, or public display (commercial or non-commercial);
    3. Attempt to decompile or reverse engineer any software on DrumTag's site;
    4. Remove copyright or proprietary notices from the materials;
    5. Transfer the materials to another person or "mirror" them elsewhere.
  2. This license automatically terminates if you violate these restrictions and may be terminated by DrumTag at any time. Upon termination, you must destroy any downloaded materials.

5. Fair Use & Prohibited Conduct

You agree not to:

  • Tamper with, falsify, or manipulate offers, rewards, check-ins, accounts, or system data.
  • Hack, reverse-engineer, bypass, or disable any part of our software, security measures, or signage devices.
  • Create fake accounts, artificially inflate activity, or redeem rewards without meeting requirements.
  • Post or transmit content that is hateful, harassing, discriminatory, threatening, or otherwise inappropriate.
  • Interfere with or disrupt the normal functioning of the Services.

6. Fraud & Abuse Prevention

Fraud and abuse are actively monitored. If suspicious activity is detected, we may suspend accounts, revoke offers, and, if necessary, cooperate with law enforcement.

7. Rights to Refuse Service

We may refuse or suspend access to the Services for any user, customer, or location at our discretion to protect the platform's integrity.

8. Data & Content

By using the Services, you grant us permission to store, process, and transmit your information for the purpose of operating and improving the platform. Locations receive only the data necessary to fulfill offers and measure results, and personally identifiable information is shared only with explicit user consent.

9. Intellectual Property

All trademarks, service marks, logos, and content are the property of CROWBAR IT INC. or its licensors.

10. Disclaimer

The Services are provided “AS IS” without warranties of any kind. DrumTag makes no guarantees of uninterrupted or error-free service.

11. Limitations

In no event shall DrumTag or its suppliers be liable for any damages arising from the use or inability to use the Services.

12. Revisions & Errata

The materials on DrumTag's site may include technical or typographical errors. DrumTag may make changes at any time without notice.

13. Links

DrumTag is not responsible for the contents of any linked site. Use of linked sites is at the user's own risk.

14. Site Terms Modifications

We may revise these terms at any time without notice. Your continued use of the site constitutes acceptance of the updated terms.

15. Governing Law

Any claim shall be governed by the laws of the State of Idaho, without regard to conflict of law provisions.

16. Charges

Message & Data Rates May Apply. DrumTag and participating retail locations are not responsible for any data usage charges you may incur.

17. Catch-All Protection

If an action—whether or not explicitly listed in these Terms—harms the platform, its users, or its partners, we reserve the right to take any lawful action necessary to protect the integrity of the Services.
